EU funding has to be fought for sometimes
For our client in the healthcare industry, a non-public care facility, we had to win the EU funding in front of the Administrative Court. The case was won twice, in front of Voivodship and im front of the Supreme Administrative Court.
This is the success of the team lead by Natalia Sobolewska, who correctly noted the lack of precision in the selection criteria for projects imposed by the funding party. Such lack of precision is not acceptable in any competition documentation when it leads to projects discrimination.

Another success in scope of competition protection
We won an important dispute concerning ungrounded fees related to goods sales. Entities holding key role in particular markets are forced, as a result of the cases ran by us, to alter their practice violating fair competition rules.

Dispute covering public procurement concluded with a victory
We won a dispute in front of National Appeal Chamber covering the construction of radiofpharmaceuticals manufacturing plant with the total value of circa 100 million zloty. Thanks to our success, the investment process may be executed without delays, which is crucial, while the project is aimed at production of isotopes highly demanded in Europe. "Closing this dispute shall significantly speed up the market delivery of pharmaceuticals, which supply was in Poland in shortage" - clams attorney Michal Wilczynski.

Infrastructure project dispute success
Within our public procurement practice we led to the successful settlement of the dispute in the tender for the execution of integrated transportation system in front of the National Appeal Chamber. Att. Filip Janyszek represents our client as the ordering party in one of the major infrastructure projects. This is yet another project in which focuss is laid on regulations related to contract award criteria specified in the terms of reference. We advised The Ordering Party in specifying the terms and defending their accuracy in the dispute against an array of bidders.

We have initiated yet another significant trial with a bank operating in Poland in range of the so-called "Frank loan". The issue of loans granted in foreign currencies and exchanged by banks in arbitrary manners is still not regulated by law, which results in the need of leading individual disputes.

Appeal proceedings in front of NCA for a road infrastructure project
Within our public procurment practice we participate in yet another appeal proceedings in front of National Chamber of Appeal. Att. Filip Janyszek represents our client in a road infrastructure investment proceedings. This is another project in which focus is laid on regulations related to classifying bid documentation, jeopardizing the effective completion of the bid proceeding.

Health&fitness company sales transaction completed
As Polish health&fitness market is recognized one of the fastest growing in Europe, investors attraction seems to increase. Whitestone assisted the seller in the process of sales transaction in one of the key locations in Warsaw. Transaction amounted to PLN 2,5m and the entire process was completed within less than 8 weeks. Whitestone team was responsible for the tax impact of the transaction as well.
